Court Dishes Out GH¢2,500 Fine To Zanetor For Wasting Its Time

An Accra high court hearing the case of Zanetor Rawlings has dished out a fine of GH¢2,500 to her for wasting its time. This was after lawyers for Dr. Rawlings filed a submission of no case claiming that the suit filed by incumbent Member of Parliament, Nii Armah Ashitey lacked merit and must be dismissed. Both Zanetor and her lawyers argued that such matters be left for the Supreme Court to interpret.

However, the court presided over by Justice Kwaku Ackaah-Boafo, on Tuesday, dismissed a motion filed by Dr. Zanetor Rawlings challenging the court’s jurisdiction in a case where she has been sued over her eligibility to contest the Klottey Korle NDC parliamentary primary.

According to reports, court awarded the cost of GHC2,500 as a fine against Dr Zanetor for wasting the court’s time with “frivolous motions”.

The suit against Dr. Rawlings was a joint one filed by Nii Ashiety and Nii Coleman challenging her eligibility to contest at the MP for Klottey Korle on the grounds that she is not a registered voter. Meanwhile, Nii Coleman had pulled out of the case a few weeks ago, leaving Ashietey alone to fight the case.

Also, according to some reports, the Electoral Commission has ascertained that  Dr. Rawlings is not a registered voter in Ghana. But Zanetor has argued that the entire action is premature and asked that the case be dismissed entirely. But court in return fined her for wasting the its time.

Justice Baafo had earlier dismissed an application by Rawlings’ lawyers to dismiss the suit against her. He had ruled that the case brought before the court was worth investigating and without bias. Subsequently, the counsels were asked to open defense on the case.

The case has been adjourned to April 4, 2016.
